The Montana Department of Revenue is in charge of regulation of marijuana in Montana. To apply, you can visit the DOR website and follow their application process.

The 20% adult-use cannabis tax and 4% medical marijuana tax are distributed at the state level:

$6 million to the Healing and Ending Addiction through Recovery and Treatment (HEART) account established in 16-12-122, MCA.

After the HEART distribution, the remainder goes to:

20% to Department of Fish, Wildlife, and Parks to be used solely as funding for wildlife habitat

4% to the state park account

4% to the trails and recreational facilities account

4% to the nongame wildlife account

3% or $200,000, whichever is less, to the veterans and surviving spouses state special revenue account

$150,000 to the board of crime control to fund crisis intervention team training

The remainder to the general fund.

Distribution of Local Option Marijuana Excise tax (up to 3% on recreational and medical sales):

50% of the resulting tax revenue must be retained by the county

45% of the resulting tax revenue must be appropriated to the municipalities on the basis of the ratio of the population of the city or town to the total county population

5% of the resulting tax revenue must be retained by the department to defray costs associated with administering the Local Option Marijuana Excise tax

The recreational marijuana tax in Montana is set at a minimum of 20% while medical is at 4%. However, each county has the option to excise a max of 3% for local taxes. as of September 2023, almost every county in Montana has chosen to install the full amount for both recreational and medical marijuana sales. The only countries that haven't increased their tax another 3% are: Flathead County, Missoula County, Ravalli County, and Sanders County.

As of January 1, 2021, adults 21 and over may possess and use up to one ounce of marijuana (8 grams of concentrate) with no criminal penalties.

However, marijuana consumption and possession (including medical marijuana) remains prohibited in public and certain other locations. It is also prohibited under federal law on all federal lands and waters.  

Marijuana (except medical marijuana) is prohibited in hospitals and other health care facilities.

Operating a motor vehicle under the influence of marijuana remains illegal.

Yes, as of 2022, it is legal to purchase recreational cannabis in Montana for adults aged 21 or older. In order to purchase you must have a valid proof of ID, or have a Montana medical marijuana patient card. However, there are a few counties that have elected to continue to outlaw recreational marijuana sales: Beaverhead County and Granite County.
